Renting a Car Seat in Orlando, What Florida Law Requires

Car seats are the part of an Orlando trip most families sort out last, usually at the rental car counter at midnight after a long flight. It is worth ten minutes of planning, because Florida takes this seriously and the options are not equal.

What Florida Law Actually Says

Florida statute 316.613 requires children aged 5 and younger to be secured in a crash tested, federally approved child restraint. Broken down:

• Ages 0 to 3: a separate carrier or the vehicle's integrated child seat
• Ages 4 to 5: a separate carrier, an integrated seat, or a booster
• Ages 6 to 17: a seat belt is required by law, though a booster is still strongly recommended until the belt fits properly

Florida's law is based on age, not height or weight. Most safety guidance suggests keeping a child in a booster until they are around 4 feet 9 inches tall, which is usually well past their sixth birthday.

The Fine Is Bigger Than People Expect

This is a primary enforcement law, which means an officer can pull you over purely for seeing an improperly restrained child. Nothing else has to be wrong.

A violation carries a $60 fine plus court costs, which typically pushes the real total past $150, and it adds 3 points to your licence. Points for a child restraint violation are unusual, most states do not do that.

The Uber Rule Most Families Miss

Taxis and vehicles for hire are exempt under Florida statute. Rideshare is not explicitly exempt.

So if you plan to Uber or Lyft to dinner, to Disney Springs, or back from the airport, you should have a car seat with you. And if your car seat came with your rental car, it is sitting in the car park at your hotel.

That single point is why a lot of families end up wanting their own seat for the trip rather than one tied to a vehicle.

What the Rental Car Companies Charge

Prices at Orlando as of early 2026, before tax and airport fees:

• Alamo and National: $10 per day, capped at $70
• Sixt: $11.49 per day, capped at $98
• Hertz, Dollar and Thrifty: $13 per day, capped at $91
• Budget and Avis: $14.50 per day, capped at $87

Across Orlando providers generally, daily rates run from about $7.99 to $18.50.

The Part Nobody Talks About

The bigger issue with counter rentals is that you do not know what you are getting until you are standing in the garage with a tired toddler.

Before you accept any car seat, from anyone, check it:

• Look for cracks in the shell or frayed harness webbing
• Check the expiry date, car seats do expire, usually six to ten years from manufacture
• Make sure all the original labels and parts are there
• Install it yourself and test the fit before you drive away

If anything looks wrong, refuse it. It is your child in the seat, not theirs.

Rear Facing, and How Long

Florida's statute does not specify a rear facing age. But the FLHSMV and the American Academy of Pediatrics both strongly recommend rear facing until at least age 2, and longer if the seat allows it.

Florida also sets no minimum age for the front seat, though everyone under 18 must be properly restrained. Safety guidance is consistent here, keep children in the back until around age 13.

The Short Version

If your child is 5 or under, you need a proper car seat in Florida, and it is enforced. Decide before you land rather than at the counter, check whatever seat you end up with, and think about whether you will be using rideshare at any point during the trip.
